ایک ہی وقت میں تین طلاقیں دینے کی اجازت

أَخْبَرَنَا أَحْمَدُ بْنُ يَحْيَی قَالَ حَدَّثَنَا أَبُو نُعَيْمٍ قَالَ حَدَّثَنَا سَعِيدُ بْنُ يَزِيدَ الْأَحْمَسِيُّ قَالَ حَدَّثَنَا الشَّعْبِيُّ قَالَ حَدَّثَتْنِي فَاطِمَةُ بِنْتُ قَيْسٍ قَالَتْ أَتَيْتُ النَّبِيَّ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ فَقُلْتُ أَنَا بِنْتُ آلِ خَالِدٍ وَإِنَّ زَوْجِي فُلَانًا أَرْسَلَ إِلَيَّ بِطَلَاقِي وَإِنِّي سَأَلْتُ أَهْلَهُ النَّفَقَةَ وَالسُّکْنَی فَأَبَوْا عَلَيَّ قَالُوا يَا رَسُولَ اللَّهِ إِنَّهُ قَدْ أَرْسَلَ إِلَيْهَا بِثَلَاثِ تَطْلِيقَاتٍ قَالَتْ فَقَالَ رَسُولُ اللَّهِ صَلَّی اللَّهُ عَلَيْهِ وَسَلَّمَ إِنَّمَا النَّفَقَةُ وَالسُّکْنَی لِلْمَرْأَةِ إِذَا کَانَ لِزَوْجِهَا عَلَيْهَا الرَّجْعَةُ
احمد بن یحیی، ابونعیم، سعید بن یزید، شعبی، حضرت فاطمہ بنت قیس رضی اللہ تعالیٰ عنہا سے روایت ہے کہ میں آنحضرت صلی اللہ علیہ وآلہ وسلم کی خدمت میں حاضر ہوئی اور میں نے عرض کیا کہ میں خالد کی لڑکی ہوں اور فلاں کی اہلیہ ہوں اور اس نے مجھ کو طلاق کہلوائی ہے اور میں اس کے لوگوں سے خرچہ اور رہائش کے واسطے مکان مانگ رہی ہوں۔ وہ انکار کرتے ہیں۔ شوہر کی جانب کے لوگوں نے عرض کیا یا رسول اللہ صلی اللہ علیہ وآلہ وسلم اس عورت کے شوہر نے اس کو تین طلاقیں دے کر بھیجا ہے اس پر آپ صلی اللہ علیہ وآلہ وسلم نے ارشاد فرمایا اس کا نان نفقہ اور رہائش کے واسطے جگہ اس خاتون کو ملتی ہے کہ جس خاتون سے مرد طلاق سے رجوع کرے اور تین طلاق دینے کے بعد طلاق سے رجوع نہیں ہو سکتا۔ اس وجہ سے ایسی عورت کا نان نفقہ بھی نہ ملے گا۔
Sahl bin Saad As-Sa’idi narrated that ‘Uwaimir Al-’Ajlani came to ‘Asim bin ‘Adiy and said: “What do you think, ‘Asim! If a man finds another man with his wife, should he kill him, and be killed in retaliation, or what should he do? ‘Asim! Ask the Messenger of Allah صلی اللہ علیہ وآلہ وسلم about that for me.” So ‘Asim asked the Messenger of Allah صلی اللہ علیہ وآلہ وسلم g about that, and the Messenger of Allah صلی اللہ علیہ وآلہ وسلم disapproved of the question, and criticized the asking of too many questions until ‘Asim felt upset. When ‘Asim went back to his people, ‘Uwaimir came to him and said: “‘Asim, what did the Messenger of Allah صلی اللہ علیہ وآلہ وسلم say to you?” ‘A said: “You have not brought me any good. The Messenger of Allah صلی اللہ علیہ وآلہ وسلم disapproved of the question you asked.” ‘Uwaimir said: “By Allah, I will go and ask the Messenger of Allah صلی اللہ علیہ وآلہ وسلم – So he went to the Messenger of Allah صلی اللہ علیہ وآلہ وسلم and found him in the midst of the people. He said: “Messenger of Allah صلی اللہ علیہ وآلہ وسلم, what do you think if a man finds another man with his wife should he kill him, and be killed in retaliation or what should he do?” The Messenger of Allah صلی اللہ علیہ وآلہ وسلم said: “Something has been revealed concerning you and your wife, so go and bring her here.” Sahl said: “So they engaged in the procedure of Li’án, and I was among the people in the presence of the Messenger of Allah صلی اللہ علیہ وآلہ وسلم . When ‘Uwaimir finished he said: “I would have been telling lies about her, Messenger of Allah صلی اللہ علیہ وآلہ وسلم, I keep her.” So he divorced her thrice before the Messenger of Allah صلی اللہ علیہ وآلہ وسلم told him to do so.
